Building Restrictions

 

1.      No billboards, signs, or advertising device of any kind shall be erected, placed, or suffered to remain on said premises.  Exception:  Real Estate “For Sale” Signs.

 

2.      No house, building, or structure, except fencing (4 to 6 foot height) shall be erected thereon nearer than 20 feet to the side and rear boundaries nor nearer than 50 feet from the front lot line.

 

3.      No intoxicating beverages shall be manufactured or sold on said premises.

 

4.      No present or future owners of all, or any part, of said premises shall occupy any garage or any unfinished building or dwelling, including house, trailer, mobile home, pre-fabricated home, modular home, unified home,, or double-wide home whether for temporary or permanent residence, and no garage shall be erected on said premises or any part thereof except contemporaneously with or subsequently to the erection of the dwelling house on said premises, and shall be at least a three car garage.  No camping or unlicensed vehicle is to be stored outside and vehicle must be moved weekly.

 

5.      The premises shall be used for private, single family residential purposes only and may not be subdivided to accommodate any second residence thereon.  The premises may not be used as a means of ingress and egress to any other premises.

 

6.      No dwelling house shall be erected on said premises in which the floor space, exclusive of basements, garages, breezeways, porches, or decks, shall be less than the following:

 

a.       2,200 square feet – One Story Home

b.      2,800 square feet – Split Level Home

c.       3,200 square feet – Two-Story or Multi-Level Home

 

7.      All utilities are to be in-ground.  No above ground utilities.

 

8.      Any residence or garage erected on said premises must be completed within 14 months from the time when construction is commenced and each residence must have a garage (2-car minimum) with yard excavated and seeded.

 

9.      The owner of the premises must arrange for trash removal at least weekly. 

  

10.  No unsightly equipment of any kind shall be maintained or allowed on said premises and no nuisance shall be committed, suffered, or maintained on said premises or any part thereof.

 

11.  Before construction is started, each owner or builder shall contact the Board of Health with the location of the proposed dwelling, driveway, sewer plant, and sewer disposal, if required.

 

12.  Enforcement of these covenants shall be by proceedings at law or in equity against any person or persons violated or attempting to violate any covenant, either to restrain violation or to recover damages.

 

13.  Invalidation of any of these covenants by judgment or court order shall in no way affect any of the other provisions, which shall remain in full force and effect.

 

14.  No animals, livestock, poultry, or exotic animals of any kind shall be raised, bred, or kept on any lot, except that dogs, cats, and other household pets may be kept, provided that they are not kept, bred, or maintained for any commercial purpose.  There will be no kennels of any kind.

 

15.  Ditches shall be maintained for the purpose of keeping them open and unobstructed for the flow of storm water runoff.

 

16.  House alignment with surrounding houses must be approved by the land developer.

 

17.  All utility buildings and other structures must have the same siding as the house and be approved by the land developer.

 

18.  All house plans must be approved by the land developer.

 

19.  All one and two-story homes will be constructed on full basements.

 

20.  Homes are to be constructed of:

 

a.       Natural stone or brick.  Cultured Stone to be approved by the land developer.

b.      Combination of stone and stucco.

c.       Log or natural wood finish.

d.      Brick/stucco and log/natural wood finish.

 

21.  All swimming pools will be of the in-ground type with safety fence.  No above-ground pools allowed, temporary or otherwise.
